SWC Ltd Terms & Conditions of Business

1. CDM

  • Under CDM regulations 2015 Shepworth Construction Limited is the Principal Contractor unless otherwise stated. 
  • The Project Design is the responsibility of the Client unless an approved Architect and/or Structural Engineer will be the Principal Designer of the proposed project. 
  • We work in accordance to the architects design, specification and calculations. We project manage the full project to arrange other contractors and deal with building control including certifications required for final sign off. 
  • All works are undertaken by Shepworth Construction Limited and/or relevant parties within
  • The Project Management is the responsibility of Shepworth Construction Limited, including all project related works. Correspondence with the Client will be overseen by ourselves throughout the projects duration.
  • At the request of our Clients wishes, we can work alongside other Contractors but we maintain the right as the Principal Contractor to remove non compliant Contractors from the project for the good of said project

2. Contractual Conditions

  • This offer will form a written contract between The named Client on page one of the document and Shepworth Construction Ltd, which includes all services and materials laid out within the quotation specification and breakdown! Acceptance of this quotation is required in writing by signing the Contract Declaration sheet below to schedule a start date.  Start dates can be pre-discussed to ensure it mutually benefits both parties prior to acceptance!
  • By confirming your interest, the client conforms to all details of these terms & conditions with no exceptions, enforcing the contract 
  • All quotations offered are guaranteed for a 60 day period from the date of the quotation, prior to your acceptance
  • Quotations are based on current material costs. Should there be a notified material cost increase, we reserve the right to amend our prices accordingly!
  • Any works not listed within this quotation will be deemed additional and will be charged accordingly
  • Additional works or "Extras" will be discussed and confirmed. Additional costs will require acceptance from the client prior to the works been undertaken
  • Any alterations to set working drawings and specifications by the Client will need to be confirmed to the acting architect, structural engineer and confirmation obtained from local authorities where necessary by the Client.  
  • Shepworth Construction Ltd holds no responsibility to Clients changing their design and delays to projects will be charged additionally.
  • Where lead times for such alterations are incurred, we would leave site and a future time slot would be booked for our return. This will only come into affect where other works are not possible bringing the job to a halt!
  • All Goods remain the property of Shepworth Construction Ltd until full payments are received

3. Rights of Cancellation & 20% Penalty Clause 

  • Jobs confirmed to start after 60 days lead time from acceptance of the quotation - Notice of cancelations must be given no later than 60 days prior to the scheduled work commencing.
  • Jobs confirmed to start within the next 60 days time - Clients waiver their cancelation period starting from your acknowledgement and acceptance of our quotation.
  • Failure to cancel scheduled works later than the 60 day pre start window, will result in a 20% Penalty Clause (20% of the original quotation). Charged for loss of working hours and disruption of business! 
  • Failure to pay will result in a Debt Collection Agency been enforced and failure to pay thereafter may result in court proceedings.

4. Payment Terms

  • Shepworth Construction Limited works on a 14 day Max Payment period from the invoice date. Payments not received after 14 days will generate reminder invoices for consecutive 7 day periods. 
  • If payment is still not received 30 days after the 14 day payment period both late payment interest and compensation charges from the invoice date onwards will be enforced (subject to vat) until the total invoice amount including all charges applied is paid! 
  • These charges will be backed by the *Late Payment of Commercial Debts (Interest) Act 1998*
  • Stage payments are required within 7 working days from the invoice issue date. If these terms are not honoured further charges will apply and work will cease until payment is received
  • These terms are enforced and are non-negotiable 
  • Shepworth Construction Ltd reserves the right to not undertake or cancel the project if funds are not transferred as agreed upon your acceptance of our quotation and the Terms and Conditions highlighted within.

5. Commercial Projects

  • Refer to point 2 prior to acceptance 
  • Commercial projects are identified as contracts to Hospitals, Medical Centres, Schools and other education buildings, Highways and business premises.
  • A single project with a net quotation cost of £2,000.00 or over including site addresses with multiple smaller projects equating to £2,000.00 or over will be required to pay 50% of the Quotation cost. A pro-forma Invoice will be issued and requires payment in full prior to any works commencing. The remaining 50% will be paid on invoice upon completion
  • Shepworth Construction Limited works on a 14 day Max Payment from invoice period.
  • Payments not received after 14 days will generate reminder invoices for consecutive 7 day periods.

FAQs

Q. "Can I get a quotation without having any architectural drawings?"

A. We can offer a site visit and price a cost as an estimate! Rather than an official quotation, an estimate of cost will not be accurate and will require an official written quotation before any further action is taken.


Q. What are the minimum requirements I need to build an extension to my home.

A. Most Projects require Architectural Drawings, Planning Permission from your local Council and Building Regulations. There are exceptions but please check with your local Council.


Q. My quotation includes VAT! Do I have to pay the VAT?

A. We are a VAT registered Company and must charge VAT at an additional 20% above the Net quotation cost. All purchased materials are chargeable with VAT at the point of purchasing, so the additional cost is only incurred on the Labour part.
